Gujarat HC gives spilt verdict on Gujarat lokayukta case

In a verdict spilled, Gujarat high court Monday stated his appointment lokayukta situation in most bench. Justice Akil Qureshi confirmed the appointment of Justice RA Mehta, the Governor Kamala Beniwal and Justice Sonia Gokani, another judge on the bench division
disagreed.

The Modi government had challenged the appointment Beniwal Justice Mehta as lokayukta - a position that is vacant since 2003.

The government had argued that the definition was questioned because lokayukta supported by Congress and Raj Bhawan appeared to be acting at the behest of the opposition party.

On August 25 Beniwal had given notice of the appointment of Justice Mehta in Gujarat lokayukta, bypassing the state government, which sat on the file for months.

Subsequently, the government had approached Modi rushed the court denies an appointment on the grounds that the appointment was unconstitutional and the government was bypassing the State.

In the confrontation between the governor and chief minister on the issue lokayukta, the state government had included the name of the captain and newly appointed lokayukta Justice RA Mehta as respondents in the petition, which was filed on August 26 in a few hours after the governor issued a statement on the appointment.

The commander had made the appointment in consultation with high court of the Supreme Court SJ Mukhopadhyaya and Head of the opposition in the Legislative Assembly Shaktisinh Gohil under Article 3 of the Gujarat Lokayukta Act, official sources said.

The government had constituted a five-group of ministers to review the Gujarat Lokayukta Act and also appointed Justice MB Shah Commission to examine the 15 accusations made by the Court against the state government.
